Bird & Lovibond secures six figure injury claim

Bird & Lovibond recently acted on behalf of a client who was left with serious leg injuries that forced a change of career.

The injury happened when the client was leaving a hospitality venue and endured a fall as a result of an unsafe surface.

The owners of the venue accepted liability, but suggested to the Court that the individual had acted in a ‘fundamentally dishonest way’ in relation to the case. Should this have been accepted by the Court, the client could have faced costs or even imprisonment. However, the Court decided that this was not the case and the client ‘had not made any misleading statements.’

Acting on behalf of the client, Bird & Lovibond had offered to settle the claim through a ‘Part 36’ offer whereby a settlement figure is agreed between the two parties. This was rejected, and the defendant ultimately had to pay the costs of the injured party.
